These Terms of Service (the "Terms") apply to every purchase made on www.shapersimage.com (the "Site"), which is operated by Shapers Image, LLC, a Florida limited liability company, 700 S Rosemary Ave, Suite 204, West Palm Beach, FL 33401, United States ("Shapers Image", "we", "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Orders and acceptance

Your order is an offer to buy. We accept it when we ship it and email you a shipping confirmation. We may refuse or cancel any order, for example because of a pricing or stock error, suspected fraud, or a shipping address we cannot serve; if we do, we refund any amount already paid.

2. Prices and payment

All prices are in US dollars and exclude shipping and taxes unless stated otherwise. Sales tax is added at checkout where required by law. We may change prices at any time; the price shown at checkout is the price you pay. Payment is processed by Shopify Payments and the payment providers shown at checkout; we never see or store your full card number.

3. Discounts and promotions

One discount per order, never combined. Discount codes and automatic offers cannot be stacked. Free shipping is the only offer that can apply together with a discount code. Codes have the expiry date shown when issued and are not extended. Volume (wholesale) pricing on paperboard inserts is not combinable with any code.

4. Shipping

Shipping terms, delivery times and the free-shipping thresholds are set out in our Shipping Policy, which forms part of these Terms. Risk of loss passes to you when the carrier accepts the package. International buyers are responsible for duties and taxes.

5. 30-day satisfaction guarantee, returns and refunds

Unused items in their original packaging may be returned within 30 days of delivery for a full refund, as described in our Refund Policy, which forms part of these Terms. Sale items and gift cards are final sale.

6. Product use and care

Our shapers and inserts are designed to be placed inside caps and hats to support their shape. They are not a safety device. Follow the care instructions on the Site: hand wash caps only, wipe inserts with mild soap, rinse and air dry; keep inserts away from dryer heat and heat presses.

7. Intellectual property

SHAPERS IMAGE® is a registered trademark of Shapers Image, LLC. All text, photos, videos, designs and product names on the Site belong to us or our licensors and may not be copied, resold or used commercially without our written permission.

8. Accounts, text messages and email

You are responsible for keeping your account details confidential. If you opt in to text messages or email, you can opt out at any time by replying STOP or using the unsubscribe link. Message and data rates may apply.

9. Reviews and user content

By posting a review, photo or comment on the Site, you give us a non-exclusive, royalty-free right to display it in connection with our products. Do not post content that is unlawful, misleading or infringes anyone's rights.

10. Warranty disclaimer and limitation of liability

Except for the 30-day satisfaction guarantee above, products are provided "as is" and we disclaim all other warranties, express or implied, to the extent permitted by law. To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential damages. Some states do not allow these limits, so they may not apply to you.

11. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute that cannot be resolved by contacting us first will be brought in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction. Nothing in these Terms limits consumer rights that cannot be waived under the laws of your state.

12. Changes to these Terms

We may update these Terms from time to time. The version posted on the Site at the time you place an order applies to that order.
